Terms & Conditions

These Terms govern your access to and use of PostToViral. By creating an account, connecting a third-party platform, purchasing a subscription, publishing content, or using an advertising feature, you agree to these Terms.

1. Service

PostToViral provides social publishing, scheduling, engagement, analytics, account-management and supported advertising workflow features. Availability varies by platform, account type, permissions, API access, product release and third-party policy.

2. Accounts and Connected Platforms

You are responsible for your account credentials, authorized users, connected social accounts and permissions. You must comply with the terms and policies of Meta, Facebook, Instagram, TikTok, YouTube/Google and any other connected service. Third-party platforms may change, restrict or discontinue APIs or features without notice.

3. User Content and Rights

You retain ownership of content you submit. You grant Amaran LLC a limited, non-exclusive license to host, process, format, transmit and display that content only as needed to operate PostToViral and complete actions you request. You are responsible for ensuring you have all necessary rights, licenses, releases and permissions for the content, music, footage, marks, audiences and claims you use.

4. Publishing and Platform Behavior

PostToViral helps send content and actions to third-party platforms, but we do not control their review systems, delivery, reach, account status, moderation, algorithms, rate limits or outages. A platform may reject, delay, modify, remove or limit content or connected-account functionality.

5. Advertising and Meta Charges

Where available, PostToViral may help you configure eligible Facebook and Instagram advertising workflows. Advertising spend, taxes and platform charges are separate from your PostToViral subscription and are governed by the applicable Meta terms and billing arrangements. You are responsible for campaign claims, creative, targeting, budgets, legality and compliance.

6. Subscriptions, Trials and Billing

Paid plans renew according to the billing interval you select until cancelled. Current prices, plan limits and trial details are shown on the pricing or checkout experience and are incorporated into these Terms. Cancellation stops future renewal but does not automatically cancel third-party advertising campaigns or third-party charges.

7. No Performance Guarantee

We do not guarantee virality, distribution, impressions, views, followers, engagement, leads, bookings, visits, sales, revenue, return on ad spend or any other business result. Social and advertising results depend on factors outside our control.

8. Acceptable Use

You may not use PostToViral to violate law, infringe rights, distribute malware, impersonate others, mislead users, abuse platform APIs, evade platform restrictions, send unlawful communications, or publish content you do not have the right to use.

9. Suspension and Termination

We may restrict or suspend access when reasonably necessary to protect the service, users, third-party platforms, security, legal compliance or our contractual rights. You may stop using the service and disconnect supported accounts at any time, subject to billing and retention terms.

10. Disclaimer

Except where prohibited by law, the service is provided on an “as available” basis. We do not warrant uninterrupted platform availability, third-party API availability, advertising approval, specific delivery times, or compatibility with every account or content type.

11. Limitation of Liability

To the maximum extent permitted by law, Amaran LLC and its affiliates will not be liable for indirect, incidental, special, exemplary, punitive or consequential damages; lost profits, revenue, data, goodwill or business opportunity; advertising spend or campaign loss; third-party platform actions, outages, restrictions or account decisions; or unauthorized use caused by your failure to secure credentials. To the maximum extent permitted by law, aggregate liability arising from the service will not exceed US $50.

12. Indemnification

You agree to defend, indemnify and hold harmless Amaran LLC and its affiliates from claims, liabilities, losses and reasonable costs arising from your content, advertising, targeting, platform use, violation of law, violation of third-party rights, or breach of these Terms.

13. Governing Law and Disputes

These Terms are governed by Delaware law without regard to conflict-of-law principles. Where enforceable, disputes will be resolved through binding arbitration, with proceedings or permitted court matters located in Dallas County, Texas.

14. Changes

We may update these Terms as the service changes. Material updates will be posted through the service or website. Continued use after an update becomes effective constitutes acceptance of the revised Terms.
